The story was either wrong because someone there made a mistake or because the Caller intended to plant a false anti-EPA story knowing it'd garner a lot of attention and end up as a common conservative talking point, even though it was false. While the "mistake" option seemed the most likely answer at first, the Caller's executive editor now has me convinced that this was intentionally bad journalism.

The Caller claimed to have learned that the EPA was planning to hire "230,000 new bureaucrats ? at a cost of $21 billion" to implement new greenhouse gas regulations. That was the scoop. $21 billion and 230,000 new EPA bureaucrats! That is false. It's based on a misreading of a Justice Department brief filed in the U.S. Court of Appeals DC circuit, which presents the "$21 billion" figure as an example of what the EPA would need to regulate emissions if the rule they're going to court to defend is blocked.

Here's Politico -- noted left-wing rag Politico! -- handily debunking the story:

?Hiring the 230,000 full-time employees necessary to produce the 1.4 billion work hours required to address the actual increase in permitting functions would result in an increase in the Title V administration costs of $21 billion per year,? DOJ wrote.

DOJ adds that the tailoring rule is designed specifically to avoid that kind of scenario.

The EPA determined that phasing in the statutory limits would still allow most of the emission benefits ?while avoiding the permit gridlock that unquestionably would result from the immediate application? of the thresholds laid out in the Clean Air Act, DOJ said in the brief.

Who is fighting this "tailoring rule"? The biggest industrial polluters, as Kate Sheppard explains. The tailoring rule means opening up the permitting process to the biggest emitters first, because otherwise the EPA would have to immediately begin regulating every greenhouse gas emitter in the country, which would be a bureaucratic disaster and insanely expensive. Again: This is what the EPA would like to avoid. Polluters want to block the rule in order to force the EPA to give up on this crazy idea of regulating greenhouse gas emissions entirely.

So the Caller read a DoJ brief incorrectly. It happens! Those things are written in legalese, who can understand any of it?

They admitted their screw-up and moved on, right? No. Instead, they continue to insist that they're right, and that the Obama administration purposefully and explicitly seeks to destroy American industry while bankrupting the nation by expanding the size of the EPA 13-fold and increasing its budget by $21 billion, and this secret plot was buried in a legal brief that they and they alone understand.

The Caller's executive editor, one David Martosko, writes an editor's note attacking all the Callers critics as left-wing pinkos and liars. "Despite the criticisms that some have offered," he writes, "we haven?t changed a word." It must be correct, then, because no one ever intentionally lies on the internet.

Martosko goes on to describe the filing with a marginally greater degree of accuracy, making this editorial something of a snide, defiant walk-back (a right-wing media special), but he insists on the opposite-day reading of the filing's argument that underpins the Caller's scoop, which was of course already latched onto by Fox and by anti-enviromental Republicans in Congress.

Dave Weigel charitably writes that Martosko "doesn't really know what the 'facts' are," but Weigel also notes where Martosko used to work: the "communications firm" Berman and Company, where he was, until this August, "senior strategist and director of research."

Berman and Company is quite objectively in the business of manufacturing misinformation. They don't just lobby politicians or send out press releases, they create front groups and spread specious pro-industry "research." Martosko's former job was to deceive journalists.

Any senior Berman and Company strategist would know how to take a document like this legal filing and argue that it says the opposite of what it says. They teach that on day one. (I would also not be shocked to learn that some of the polluters challenging the EPA in court are among Berman and Company's clients, but there's no way to know -- Berman generally makes sure his clients names appear no where near his work promoting their interests.)

Why would any organization supposedly dedicated to journalism hire a Berman and Company "strategist" as executive editor? If your political beliefs align, let him write a column every week or something, but someone for whom truth is a malleable resource to be bent in the service of promoting influential industry players is not really someone you want in charge of a newsroom.

Unless, of course, "winning" the stupid partisan argument is actually more important to you than reporting reality.

7 students arrested in SAT cheating scheme

A college student flew home to New York to impersonate high schoolers who paid him to take the SAT on their behalf, and even took the exam twice in one weekend under different identities, prosecutors said Tuesday.

Between 2010 and 2011, six students at Long Island's Great Neck North High School paid Sam Eshaghoff, 19, between $1,500 and $2,500 each to take the SAT for them, Nassau County District Attorney Kathleen Rice said.

All seven students involved were arrested for their alleged roles in the cheating scandal Tuesday morning. Eshaghoff faces up to four years in prison, NBCNewYork.com reported. The six who are charged with hiring him face misdemeanor charges; their names are not being made public due to their ages.

Eshaghoff graduated in 2010 from Great Neck North, a public school that ranks among the nation's best, according to FOX News, with notable alumni including filmmaker Francis Ford Coppola. Eshaghoff spent his freshman year at the University of Michigan, then transferred to Emory University in Atlanta sophomore year.

He flew back to Long Island on numerous weekends to take the SAT, where the high school students had registered at different schools so their faces wouldn't be recognized, prosecutors said. Eshaghoff presented a forged driver's license with his picture and the paying student's name each time he took the test, they said.

A perfect SAT score is 2400. Eshaghoff scored between 2140 and 2220 for the students, New York Daily News said.

At least once, Eshaghoff impersonated two students in one weekend, flying home from school to take the test twice, Rice said.

"Colleges look for the best and brightest students, yet these six defendants tried to cheat the system and may have kept honest and qualified students from getting into their dream school," Rice said.

Eshaghoff also allegedly took the test for a seventh student, a girl, but did not make her pay, the Daily News reported.

Scores didn't match up with GPAs
High school faculty had become suspicious when they heard rumors of students paying a third party to take the SAT for them early this year, prosecutors said. They managed to nail down the six suspected high schoolers by comparing past academic performance to SAT scores of students who had taken the test at a different school.

The giveaway was "large discrepancies between [the six students'] academic performance records and their SAT scores," said Rice, reported FOX. She said administrators were able to track the tests to Eshaghoff after a handwriting analysis.

The district attorney's office said it is also investigating whether Eshaghoff took the exam for other students, and whether cheating has taken place at at least two other high schools in the county.

"Colleges look for the best and brightest students, yet these six defendants tried to cheat the system and may have kept honest and qualified students from getting into their dream school," Rice said.

Eshaghoff's bond was set at $1,000. The other six were released on their own recognizance.

Eshaghoff's attorney, Matin Emouna, said his client is not guilty. "He has cooperated with the investigation, and he denies the charges," Emouna said, according to FOX.

Educational Testing Service (ETS), which administers the SAT, was unable to provide documentation of cheating to prosecutors, citing a computer crash, according to NBC. If students are suspected of cheating, ETS's policy is not to notify colleges or high schools, but simply to cancel the score and offer a refund or a chance to take the test again for free, NBC reported.

Great Neck School District released a statement saying it "does not tolerate cheating" and remains "committed to cooperating with law enforcement in the matter."

How Education Has Changed Over The Years | Article Tavern

Education certainly has changed since I was at primary school in Britain more than 3 decades ago. The curriculum and teaching resources now are fantastic. The thought that goes into child development is impressive. You would have thought that all of the stress would be on learning, but far from it.

Schools now recognize that youngsters are still physically developing when they first start school, and they love learning in a physical way. So now they incorporate physical learning exercises into the curriculum, and not just in the type of playing soccer or gym exercises.

Children are encouraged to take time out to stretch, to sing and to performing physical movements as a means to finding out about themselves and the world they live in. They performing talking exercises in song form so they can phonetically understand the sounds words make. This is known as ?Jolly Phonics?. It certainly takes the drabness out of the school system.

When I was at school I did not start to learn French until I was 11. I found it a drag and really tough to understand. Now youngsters learn French & Spanish in the 1st year of primary school. They will not be swallowing compendiums or anything apart from they learn phrases in a fun educational way. It's also simpler for children to pick up new things, so I like the idea of developing languages in children at a younger age.

The coaching resources have actually gotten more advanced. Back when I was at school there was a blackboard and chalk. Then when I went to secondary school at 11 I discovered the state of the art howdy tec rolling blackboard. I was like wow advanced or what.

These days classes are replete with whiteboards, interactive whiteboards at that. That implies you can write on them. Saab wins bankruptcy court appeal | Online Finance & Insurance ...

Troubled carmaker Saab will seek bankruptcy protection after winning a court appeal against a decision earlier this month preventing it from doing so.

The court of appeal said its decision ?reverses the district court ruling and allows Saab to reorganise?.

The carmaker has been trying unsuccessfully to get new funding to ensure the business?s survival.

It hopes bankruptcy protection will give it time to secure new investment from China.

Saab has been struggling with falling sales and was forced to suspend production in April.

Two Swedish unions had applied for the company to be declared bankrupt, because it has been unable to pay wages.

Chinese investment

Swedish Automobile, formerly called Spyker, bought Saab from US giant General Motors in January 2010.

Before the summer, Swedish Automobile announced that two Chinese firms would buy minority stakes in the company.

However, these deals have not yet had regulatory approval in either Sweden or China and analysts have cast doubt on whether the Chinese government will approve the investments.

They also need to be approved by the European Investment Bank (EIB).

Monaco shines light on daytime with 'Dirty Soap' (AP)

NEW YORK ? Kelly Monaco says reality TV stars who claim to forget the cameras are following them are lying.

"How can you forget there's a camera in your face?" she asked. "You have to edit yourself in life, period, no matter who you're around, no matter what you're around. You're constantly aware of your surroundings, and if you're not, you're a complete moron."

The "General Hospital" actress, who has played Samantha McCall Morgan since 2003, would know. She recently signed on to "Dirty Soap" on the E! Network. The show, produced in part by former "All My Children" cast members Kelly Ripa and husband Marc Consuelos, follows young, hot soap stars to give a behind-the-scenes look at their lives.

The 35-year-old Monaco says she took the job because she knows it's important to bring attention to the troubled soap opera genre.

"The daytime community is in such dire need and in such trouble that they need a show like this," she said.

Her words aren't extreme. "All My Children" airs its final episode Friday. "One Life to Live" will go off the air in January.

One way General Hospital" has gotten more attention is by having actor James Franco take on a recurring role of a demented artist named Franco. He's had four different short stints on the show.

"I know there's been speculation in the past of `What's James doing coming to `General Hospital'? There has to be a bigger, greater picture," Monaco says. "I let that steer me for a while in a direction of not really appreciating him being there, and I've definitely changed my opinion on that."

She continued: "You're an Oscar-nominated actor coming in and hanging out with us and trying to put daytime on the map again.'"

Aside from "General Hospital," Monaco has the distinction of being the first winner of "Dancing with the Stars."

"I will take that to my grave," she jokes.

Monaco says she knew almost immediately the show was a phenomenon. "As long as they keep casting the way they're casting and staying current and updating the sets, they'll be good," she said.

She doesn't dismiss the idea of a "Dancing with the Stars" all-star season with former champions competing against one another.

"They'll do that when the ratings start to drop. For sure," Monaco said. "I'm already prepped for the call."

But, would she do it?

"I'd fight with myself for probably a week or two of the pros and cons. It's the Gemini in me," she said. "And then I'd be like, `You can't back down from a challenge, Kelly!' and then the other side would be like, `Yes, you can! They're really good dancers!'"

"General Hospital" airs weekdays on ABC. "Dirty Soap" premieres Sunday at 10/9c on E!

Analysis: New drugs drive prostate cancer market growth (Reuters ...

(Reuters) ? Options for treating prostate cancer are expanding with the advent of novel, and more expensive, medicines, with key data expected soon for what could be one of the biggest new drugs.

After surgery or radiation, prostate cancer patients are typically treated with drugs, like Lupron, that trick the testicles into ceasing production of testosterone, the male hormone that fuels prostate cancer cell growth.

Better understanding of the molecular abnormalities underlying the disease has led to new approaches, including Johnson & Johnson?s Zytiga, which works inside cancer cells to block testosterone production, and Dendreon Corp?s Provenge, a therapeutic vaccine designed to spur the body?s immune system to attack malignant cells.

Decision Resources, a healthcare advisory firm, expects global sales of prostate cancer drugs to more than double from nearly $4 billion in 2009 to $8.9 billion in 2019.

?We now have more effective agents targeting the androgen (testosterone) receptor,? said Dr. Elizabeth Plimack, an oncologist at Philadelphia?s Fox Chase Cancer Center. ?At some point all patients will probably be completely resistant to these drugs ? ultimately we need a new approach.?

Medivation Inc is developing a drug, known as MDV3100, designed to interfere with the ability of testosterone to bind to prostate cells.

KEY MEDIVATION DATA AWAITED

Full results from a pivotal trial of MDV3100 are due next year, but there is widespread debate over whether an interim analysis ? expected before the end of this year ? might prove that MDV3100 is effective and the trial could be stopped early.

If that happens, shares of Medivation ? which were trading at $19.05 early Monday afternoon ? would jump to $30 or $35, according to Citigroup analyst Lucy Lu. If, however, the interim analysis is negative, she expects the stock to fall below $10.

?MDV3100 is certainly promising ? but we haven?t seen the data yet,? said Dr. Plimack,

Optimism about the Medivation trial centers on the fact that J&J?s pivotal trial of Zytiga, which had shown similar efficacy in earlier studies, was stopped as soon as it became clear that the drug improved survival.

Investor interest in Medivation has waned since March 2010, when the company announced the failure of a Phase 3 trial for its experimental Alzheimer?s drug.

Wall Street analysts, on average, expect the company?s sales of MDV3100 to reach $297 million by 2015, with sales by development partner Astellas Pharma forecast at $89 million, according to Thomson Reuters data.

J&J?s Zytiga sales, which have exceeded expectations since the drug?s approval in April, are forecast to reach $815 million by 2015.

The sales trajectory for Provenge remains uncertain. Analysts expect 2015 sales of nearly $1.3 billion, but that is down sharply from a nearly $2 billion average estimate before Dendreon stunned investors in August by withdrawing its own sales forecast because it was taking longer than expected for doctors to become comfortable with reimbursement issues.

?Provenge is very exciting because it is the first immunotherapy for cancer, but it is fraught with logistical issues,? Dr. Plimack said. ?Centers are nervous to take on the cost in case reimbursement doesn?t come through.?

A course of treatment with Provenge costs $93,000, while Zytiga costs $5,000 a month, usually for eight cycles.

New York area oncologists and urologists polled in a recent focus group conducted by Sanford Bernstein said Zytiga and others drugs in the same class will be used in as many as 40 percent of patients by 2015, hormonal therapies will still be used in up to 90 percent of patients, and anti-androgens like MDV3100 would be used in 70 percent to 80 percent of men with prostate cancer.

Bernstein said both groups of doctors expect Provenge to be used in up to 12 percent of patients.

Prostate cancer kills about 250,000 men a year globally and is the second most common cause of cancer death in men in the United States, after lung cancer.

Over the longer-term, drugmakers aim to move new therapies into earlier lines of treatment, possibly helping patients avoid side effects, like medical castration, that are common with current hormone-altering drugs or to reduce the need for harsh chemotherapy treatments.

In addition to MDV3100, prostate cancer medicines under development include custirsen from OncoGenex Pharmaceuticals Inc and Exelixis Inc?s cabozatinib.

For supportive care, Amgen Inc?s Xgeva prevents fractures and other bone problems in cancer patients and the company is seeking to expand its use to reduce the risk of bone metastases in certain prostate cancer patients.

Bayer AG has filed for use of Alpharadin in men whose prostate cancer has started spreading to bones.

(AP) ? French President Nicolas Sarkozy urged the Palestinians on Tuesday to drop their bid for U.N. membership and opt instead for upgraded status in the world body, but Palestinian President Mahmoud Abbas remained determined to pursue international recognition of an independent state.

Diplomats close to the talks said Sarkozy would outline on Wednesday his proposal for the Palestinians to seek approval in the General Assembly, where no member holds a veto, for a resolution that would make Palestine a non-member observer state, raising their status from that of permanent observer.

Such a move would avoid a certain U.S. veto if the Palestinian membership bid were put to a vote in the Security Council. The diplomats spoke on condition of anonymity to discuss private talks.

With Abbas determined to seek membership rather than upgraded status, the Palestinian delegation relentlessly knocked on diplomatic doors at the U.N. trying to sell their case for international recognition. Israel's prime minister, meanwhile, issued dire warnings against hasty action as he boarded his jet for New York.

The issue of the unilateral Palestinian declaration of statehood, born of decades of frustration and failed negotiations with Israel, has consumed diplomats who are gathering for Wednesday's opening of the annual U.N. General Assembly ministerial meeting.

Abbas has rejected all attempts to steer him away from formally submitting an application for full U.N. membership. He plans to submit the application on Friday when he speaks to assembled world leaders.

For his part, Israeli Prime Minister Benjamin Netanyahu, in a meeting with members of his hardline Likud Party before leaving Jerusalem late Tuesday, vowed to speak "the truth" in New York ? "the truth of a people that wants peace, a nation that was attacked time after time and that is being attacked time after time by those that don't oppose our policies but rather our very existence."

He said he would warn world leaders against prematurely establishing a Palestinian state when many issues in the conflict must still be resolved. He did not elaborate, saying this would be the focus of his speech to the U.N. on Friday, scheduled shortly after Abbas'.

The White House said late Tuesday that President Barack Obama would meet with Abbas on the sidelines of the U.N. gathering on Wednesday. Obama's diplomatic team has repeatedly said the United States, Israel's closest ally, would exercise its Security Council veto should the Palestinians win the necessary nine of 15 votes in the powerful body to adopt a resolution recommending U.N. membership for Palestine.

Officials close to the U.S. and European delegations indicated Obama would be making a last effort to steer Abbas away from a move in the Security Council that would force Washington to act on its promise to block the move. American diplomats have worked at a furious pace to lure the Palestinians back to negotiations, knowing a U.S. veto was certain to inflame anti-American sentiment in the Arab world.

While the U.S has said it will vote no, the other 14 members of the U.N. Security Council have not publicly declared their positions. China, Russia, India, Lebanon, South Africa and Brazil were all expected to vote yes. Germany was expected to vote no with the United States or abstain. Still unknown were the positions of France, Britain, Bosnia, Colombia, Gabon, Nigeria, Portugal with many saying they needed to see the text of a draft resolution before making a decision.

U.S. and other diplomats say the European Union, supported by the U.S., now was trying to work out wording of an agreement that could avert the U.N. showdown over Palestine. There was no sign, however, that either Israel or the Palestinians will agree.

Officials say Israel is being asked to accept its pre-1967 War borders with land swaps as the basis for a two-state solution. The Palestinians would essentially have to recognize Israel's Jewish character.

Those issues remain sticking points. Officials say there is also disagreement among the mediators as Russia is finds some elements unacceptable.

The officials spoke on condition of anonymity because of the sensitivity of the diplomatic negotiations.

The seemingly endless road toward peace in the Middle East, a caustic and seemingly insoluble problem, has found its way into the fiery partisanship of American politics as the races heats up for next year's presidential vote. Texas Gov. Rick Perry, the front-runner for the Republican nomination to challenge Obama, lambasted the president in a speech Friday during a campaign stop in New York.

"We would not be here today at this very precipice of such a dangerous move if the Obama policy in the Middle East wasn't naive and arrogant, misguided and dangerous," Perry said, referring to Obama's insistence early in his presidency that Israel stop constructing Jewish settlements in the West Bank and east Jerusalem, territory that would form the core of an independent Palestine.

The political give-and-take was equally fierce among diplomats clustering at the U.N.

Among his many stops on Tuesday, Abbas met with Sarkozy and British Foreign Secretary William Hague.

Were the Palestinians to take Sarkozy's advice, they would become a non-member observer state, status like that of the Holy See. That would give them an opportunity to seek membership in U.N. agencies and join treaties, including the Rome statute that established the International Criminal Court.

But Mohammed Ishtayeh, an Abbas aide, said Lebanon's President Michel Suleiman, whose country holds the Security Council presidency this month, urged the Palestinian leader to proceed with the application for U.N. membership.

Ishtayeh said discussions with Sarkozy and Hague "focused on what can be done to avoid going to the Security Council," adding that "some still believe that a way out can be found." But he said Abbas made it clear that the discussions should be focused on the aftermath of the Palestinian application to the Security Council.

France is home to an estimated 5 to 6 million Muslims, the largest such population in Western Europe. Their family backgrounds mostly are traced to former French colonies in North Africa.

French Foreign Minister Alain Juppe, who also was in New York, told Europe-1 radio in Paris that his country still was working to get Mideast peace talks restarted before the United Nations faces a vote. "The status quo is untenable," Juppe said. "The only way to settle the Israeli-Palestinian problem is direct negotiations."

Abbas also met with Arab League Secretary General Nabil Elaraby and Suleiman.

"I believe that first of all the Palestinians are entitled to be considered as a state," Elaraby said. "They enjoy the same basis as Israel . . . and they're entitled to declare the state and they have declared it and the international community has to react to that positively."

Saeb Erekat, the chief Palestinian negotiator, sat down with former British Prime Minister Tony Blair and U.S. Mideast envoy David Hale. Blair serves as the point man for the so called Quartet ? the U.S., the U.N., the European Union and Russia ? that has tried to shepherd the Israelis and Palestinian back to peace talks.

"We know that they (the U.S.) will use the veto against our demand in the Security Council. They've told us that many times," Erekat said.
