?Speed of cancer treatment is dictated by where a person lives? ? Kirsty Williams

The Welsh Labour government has presided over a failing cancer service that dictates the speed of treatment by where a person lives, according to the leader of the Welsh Liberal Democrats Kirsty Williams.

The Welsh government's target is for 95% of urgent suspected cancer patients to be seen by a cancer specialist by 62 days. Statistics have shown that the target was missed by nearly 10%, with just 86% of patients being seen within the target time. Only one Local Health Board, Aneurin Bevan, met the 95% target.

Kirsty Williams AM commented:

"Today's statistics highlight that there is a huge variation in waiting times with regards to where a person lives. It is not right that Abertawe Bro Morgannwg LHB has only 75% of patients starting treatment with 62 days, compared to 97% of patients being seen by Aneurin Bevan. The Welsh Labour Government has presided of a failing cancer service that dictates the speed of treatment by where a person lives.

"The figures released also show that the type of cancer a person has will likely determine the speed within which they will be seen by a specialist. For example, only 52% of patients thought to be suffering from head or neck cancer were seen within 62 days. That, quite frankly, is disgraceful.

"62 days is already a incredibly long time for a person to have to wait to be seen by a cancer specialist, but being forced to wait even longer than that is completely unacceptable. It is imperative that all urgent suspected cancer patients receive treatment promptly, otherwise there is a chance that their health can seriously deteriorate in the meantime.

"It can come to no surprise to any of us that people are having to wait much longer than the target time to be seen by a cancer specialist. The Welsh Labour Government has had years of opportunity to make significant improvements to Wales' cancer services, but it has categorically failed in doing so."

Japan opposition LDP remains election favorite: poll

TOKYO (Reuters) - Japan's opposition Liberal Democratic Party (LDP) is holding its lead ahead of December 16 election, opinion polls showed on Monday, with the hawkish Japan Restoration Party (JRP) led by a nationalist former Tokyo governor coming second.

The Yomiuri daily poll showed that 25 percent of voters would choose the LDP, which is calling for aggressive monetary steps to end deflation, well ahead of the ruling Democratic Party of Japan's (DPJ) 10 percent support.

The election for parliament's powerful lower house is unlikely to fix a policy stalemate that has plagued Japan as it struggles with an ageing population, a declining manufacturing sector and the emerging power of China.

Fourteen percent of voters planned to vote for the new Japan Restoration Party, led by 80-year-old Shintaro Ishihara and popular Osaka Mayor Toru Hashimoto.

Ishihara, the outspoken former Tokyo governor who sparked a territorial row with China with plans to buy a group of disputed islands, was seen as a more suitable government leader than Prime Minister Yoshihiko Noda, according to Yomiuri's survey.

But LDP opposition leader Shinzo Abe kept his individual lead with 29 percent of voter support.

The election is expected to usher in a period of confusing coalition politics because of the emergence of new parties and because whoever wins will still lack a majority in parliament's upper house, which can block bills.

With many Japanese disillusioned with politics, 37 percent of respondents to the Yomiuri poll said they were undecided. Surveys by other media, the Asahi newspaper and Kyodo news agency, showed similar results.

The DPJ swept to power in 2009 ending more than a half a century of nearly non-stop LDP rule. But its support slumped over what voters saw as broken promises, a confused response to last year's tsunami and nuclear crisis, and Noda's unpopular policies such as a tax hike and the restart of nuclear reactors.

Travel Insurance Advice Not Always Sound With Cruise Vacations ...

travel insurance

Travel insurance for a cruise vacation is one of those things that experts say we need but is viewed by many travelers as an extra, optional expense. Many try to get the minimum coverage for as cheap as possible. After all, odds are staggeringly against needing to use it. But like most insurance, it seems expensive until we need it. Then? Instant bargain. I found that out first-hand not long ago, spending a nice pile of cash on a simple thumb-crushing injury on board Princess Cruises Grand Princess.

Travel experts seem to agree about two things when it comes to travel insurance: Get it and don't buy it through the cruise line.

"Get it" is universally sound advice. Travel agents typically receive calls from those who did not buy travel insurance but need to cancel their cruise just before sailing for a variety of reasons. They are usually always out of luck and lose most of what they paid.

"Don't buy it from the cruise line" is advice of a more self-serving nature. Third-party insurance programs are big money makers for travel agencies, commonly earning a commission of 20% or more of the cost of that third-party program.

But that advice of not buying travel insurance through the cruise line has another, not mentioned, element that sometimes surprises travelers.

Secondary Benefits-
When it comes to the medical coverage part, travel insurance commonly provides secondary benefits, tapped only after a traveler's primary health insurance has denied a claim or been exhausted. That means for the travel insurance company to pay, a claim must be made with the primary insurance carrier first. Then, whatever they don't pay, should be covered by the third-party insurance. It is a bit of a hassle but in the end the traveler gets reimbursed.

Reimbursement-
It's that "reimbursed" part that catches travelers off guard. They assume that since they have travel insurance, if something goes wrong, they are covered ... as in the travel insurance pays the service provider, if they even think that far ahead. Most don't. In reality, that's often not the case.

Covered Reasons-
First, the claim must be for a covered reason, usually some medical event that happens while on vacation. In my case, we were in rough seas on the Grand Princess with the ship listing a bit from side to side. My thumb just happened to be in the wrong place at the wrong time, caught between a metal doorframe and a metal door. Of the door, doorframe and my thumb, guess which one was out of place when the door shut? It happens.

How It Works-
Off I went to the ship's medical center, a facility fully equipped to handle my injury, much like the emergency room at a major hospital. I was treated immediately, given discharge instructions and pain medication, then sent on my way.

I travel quite a bit and have an annual travel insurance plan from a major insurer just in case something like this would happen. In the end, I suffered no financial loss and was reimbursed for all expenses associated with the injury.

But I had to pay for the medical center services before leaving the ship, then get reimbursed. Had I bought the cruise line insurance, I would have paid nothing. Ever.

What If I Can't Pay?
So what if I was on a cruise, had maxed out my credit cards and had no other sources to tap for up-front payment at the medical center? Do I walk the plank? Wash dishes?

Probably not, but its a good idea to call the travel insurance company, either the company that administers the cruise line insurance or the third-party insurance company and ask one very important question:

"If I buy your insurance, have an injury on my cruise and get treated on the ship, do I have to pay for those services before I get off the ship?"

Knowing the answer can eliminate a rather unpleasant surprise later.

Wireless network of cows to keep burps under control

Michael Slezak, Asia-Pacific reporter

rexfeatures_1141708a.jpg(Image: OJO Images/Rex Features)

I'd hate to be the IT guy fixing this network. By dropping electronic devices into the stomachs of cows and networking them together, researchers hope to reduce the climate-warming farts and burps they produce.

Emissions from livestock - much of which is methane released when they burp - are a serious component of global greenhouse gas emissions. But some individuals are a little more, erm, 'gassy' than others. By breeding "low methane" animals, and modifying farming practices slightly, their emissions could be lowered by up to 50 per cent, says Chris McSweeny from the CSIRO's?Sustainable Agriculture Flagship in Brisbane, Australia.

The problem is it's hard to measure how much cows burp while they're roaming around the paddock. So McSweeny and colleagues developed a gas-sniffing submarine that lives in a cow's stomach. Coated with a special membrane that helps it survive the harsh conditions inside, the plan is to pop them in the stomachs of whole paddocks of cows and connect them with an ad-hoc wireless network.

The device stays in the stomach for weeks and measures gas concentration using infra-red sensors. A pair of wings pops out after it enters the stomach and stops it from moving beyond the rumen - the chamber in a cow or sheep's stomach where much of the gas production occurs.

The trick now is figuring out how conditions in the animal's stomachs predict the volume of gasses they belch. If it works out, the creators imagine farms of networked, low-methane cows, with farmers able to monitor how gassy they are, and manage their feed in real time.

3D Systems Sues 3D Printer Company Formlabs For Patent Infringement, Sues Kickstarter Itself For Promotion

form1main3D systems has filed a lawsuit against both Formlabs and Kickstarter for patent infringement. Formlabs is the manufacturer of a low-cost 3D printer called the Form 1. Thanks to the stereolithography printing technique, the Form 1 can achieve professional grade 3D printing in a small hobbyist printer. It quickly became a Kickstarter success. Yet, in 1997 3D Systems patented stereolithography applications and now wants reparation from Formlabs, and Kickstarter who promoted the printer.

Interviews with Norwegians: Marion Whiteley, co-owner of ...

This article is one in a series of interviews with local businesses/organizations in Stavanger. The purpose of these interviews is to help the expat community have a peek into daily Norwegian business and lifestyle.

Interviews with Norwegians: Marion Whiteley, co-owner of Stavanger International Babysitter Service

Where are you from?

I was born in Liverpool, but I lived in Bergen most of my life. My mother is Norwegian and my father is British.

What brought you to Stavanger/ Norway?

My mother decided to come back to Norway when I was a baby. As I mentioned, most of my life was in Bergen but I also lived in San Diego, Paris and Calgary for my husband?s job, which is what also brought me to Stavanger.

How do you find it Stavanger?

It is a more international environment than Bergen. There is more of a variety of stores. You can meet unique people from all over the world here too.

Any tips for people settling into the area?

Drive around to get to know the area. Usually, when I move to a new place I drive and get lost and then put ?home? into the GPS to find my way back. In Norway, it is easier to meet people if you are outside with your kids or dog. For expats, meeting other expats is much easier than meeting Norwegians, they can be tough to get to know.

Can you tell us more about yourself?

I am married with 2 kids and 2 grandkids, at the moment. ?I used to work at the cultural department in Bergen planning festivals for a suburb of Bergen. I have worked with children for 10 years have my Masters in Business Management from BI. I have been out of Norway for 5 years and when we came back to the country, we came to Stavanger.

What got you into child care?

After talking to people at INN (International Network Norway), I realized childcare for expats was lacking. People had to turn down social invitations because of childcare needs could not be met in Stavanger. It makes the spouse even more isolated and some move back home prematurely because of that. I, too, have been in a similar situation when living abroad trying to find reliable childcare. I saw the need in the area and the business opportunity and decided to open SIBS, (Stavanger International Babysitter Service), along with my business partner, Solveig Schjelderup. Solvieg recruits and corresponds with the babysitters and personnel for the day park. She also was a registered nurse with experience in psychiatry. I take care of the customers, administration and the website.

What kind of services does SIBS offer and are they in English or Norwegian, or both?

The company officially opened in January and in mid-November the day park will open. The day park, held at the Madla Community House, is a place where parents can drop off their children and have them looked after while they run errands, meet with friends, or just need a break. For now, it is only open on Tuesdays from 9:00 to 13:00. The babysitting service is already open for business- you can book a babysitter online! SIBS is a new company, so we know the startup is essential. If interest is shown, we will open the day park on Thursdays too.

There are a few babysitters that speak Norwegian, but all speak English. Our babysitters are from all over the world. Our clients can put in requests for a specific sitter, or background they would like for them to have. ?Also, all of our babysitters have completed a first aid course that focuses on children.

How much does it cost for a babysitter? How much is it for the day park?

The client and babysitter decide what they will pay the babysitter, but we recommend 120 NOK per hour. Of course, this can be adjusted depending upon length of job and number of kids. The day park is 400 NOK per day, no matter how long the child is at the day park.

How can you be contacted?

You can go to our website, www.sibs.no, call me at 95 91 26 84 or email me at marion@sibs.no.? You can also contact my business partner, Solveig Schjelderup, by phone 98 10 94 14 or email solveig@sibs.no.

Even apes have 'midlife crises,' study finds

NEW YORK (AP) ? Chimpanzees going through a midlife crisis? It sounds like a setup for a joke.

But there it is, in the title of a report published Monday in a scientific journal: "Evidence for a midlife crisis in great apes."

So what do these apes do? Buy red Ferraris? Leave their mates for some cute young bonobos?

Uh, no.

"I believe no ape has ever purchased a sports car," said Andrew Oswald, an author of the study. But researchers report that captive chimps and orangutans do show the same low ebb in emotional well-being at midlife that some studies find in people.

That suggests the human tendency toward midlife discontent may have been passed on through evolution, rather than resulting simply from the hassles of modern life, said Oswald, a professor of economics at the University of Warwick in England who presented his work Monday in the Proceedings of the National Academy of Sciences.

A second study in the journal looks at a younger age group and finds that happiness in youth can lead to higher income a few years down the road.

More on that later. Let's get back to those apes.

Several studies have concluded that happiness in human adults tends to follow a certain course between ages 20 and 70: It starts high and declines over the years to reach a low point in the late 40s, then turns around and rises to another peak at 70. On a graph, that's a U-shaped pattern. Some researchers question whether that trend is real, but to Oswald the mystery is what causes it.

"This is one of the great patterns of human life. We're all going to slide along this U for good or ill," he said. "So what explains it?"

When he learned that others had been measuring well-being in apes, "it just seemed worth pursuing the hunch that the U might be more general than in humans," he said.

He and co-authors assembled data on 508 great apes from zoos and research centers in the U.S., Australia, Canada, Singapore and Japan. Caretakers and other observers had filled out a four-item questionnaire to assess well-being in the apes. The questions asked such things as the degree to which each animal was in a positive or negative mood, how much pleasure it got from social situations, and how successful it was in achieving goals. The raters were even asked how happy they would be if they were the animal for a week.

Sounds wacky? Oswald and his co-authors say research suggests it's a valid approach. And they found that the survey results produced that familiar U-shaped curve, adjusted to an ape's shorter lifespan.

"We find it for these creatures that don't have a mortgage and don't have to go to work and don't have marriage and all the other stuff," Oswald said. "It's as though the U shape is deep in the biology of humans" rather than a result of uniquely human experiences.

Yes, apes do have social lives, so "it could still be something human-like that we share with our social cousins," he said. "But our result does seem to push away the likelihood that it's dominantly something to do with human life."

Oswald said it's not clear what the evolutionary payoff might be from such discontent. Maybe it prods parents to be restless, "to help find new worlds for the next generation to breed," he said.

Frans de Waal, an authority in primate behavior at Emory University, cautioned that when people judge the happiness of apes, there may be a "human bias." But in an email he called the results "intuitively correct" and said the notion of biological influence over the human pattern is "an intriguing possibility."

Even happiness researcher Sonja Lyubomirsky of the University of California, Riverside, who thinks the U-shaped pattern in people is a statistical mirage, says she can't write off the ape result the same way. "I'm not really sure what it means," she said. "I am finding this very intriguing." Maybe it will spur more thinking about what's going on in both apes and humans, she said.

Oswald is also an author of a second report in the journal that finds new evidence that being happy can help young people earn more money later on. Prior research had also reached that conclusion, but Lyubomirsky and University of Virginia psychology professor Shige Oishi called the new work the best evidence yet.

"Wow," Oishi said in an email. "This is a very strong paper" in its approach.

Researchers drew on data from a huge sample of young Americans who were surveyed repeatedly. They were asked to rate their positive feelings such as happiness and hopefulness at age 16 and again at 18, and their satisfaction with life at 22. Researchers then compared their ratings with their income around age 29. The data came from nearly 15,000 participants at age 16, and at least 11,000 at the latter two ages.

Higher income at age 29 was consistently linked to greater happiness at the earlier ages. The least happy 16-year-olds, for example, went on to average about $10,000 a year less than the happiest. That disparity shrank by about half when the researchers statistically removed the effect of other influences such as ethnicity, health and education.

A happiness effect even appeared between siblings within their own families.

What's going on? Most likely, happiness raises productivity and helps a person work effectively with others, factors that promote success in the workplace, Oswald said. The study found that happier people were more likely to get a college degree and get hired and promoted.

Ed Diener, an authority on happiness research at the University of Illinois at Urbana-Champaign, said optimism probably plays a role because it helps people persist in their efforts and take on difficult goals. Since several studies, including his own, have now linked happiness to later income, that idea seems reliable, he said.

Parents should recognize that "the psychological well-being of their children is important in how well the kids will do in simple dollar terms later on," Oswald said. And unhappy people should realize that they might have to strive harder than others to focus on work and promotion rather than their unhappiness, he said.

(AP) ? Miami officials said Monday that the university is making what it called an "unprecedented decision" to self-impose a postseason ban for the second straight year, ending any chance of the Hurricanes playing in either the Atlantic Coast Conference championship game or a bowl.

Just like last year, Miami's decision was made with regard to the status of the ongoing NCAA investigation into the school's compliance practices. The inquiry began in 2011 after a former booster went public with allegations that he provided dozens of athletes and recruits with extra benefits such as cash and gifts.

By sitting out again, Miami ? which still has not been presented with its notice of allegations from the NCAA ? is hoping to lessen the hit of any looming sanctions that could be handed down when the investigation ends. Schools often self-impose penalties with hope that the NCAA takes those measures into account when doling out punishment.

"Do I think it's fair? No," Miami coach Al Golden said, asked about punishing players who have not been accused of wrongdoing. "But that's the system."

Miami clearly hopes that a pair of postseason bans, especially when the Hurricanes still had a chance at a Bowl Championship Series berth this year, helps its cause with the NCAA. Whenever the process ends, sanctions against the football and men's basketball programs are expected, with penalties likely to include probation terms and scholarship reductions.

Golden said he plans on adding about 15 recruits next year, and has already started to factor anticipated scholarship-reductions into his count.

"I'm not allowed to comment on anything relative to the investigation," Golden said. "But I'm already factoring it in to my count. They're going to tell us, ultimately, but I've already started down that road of not taking a full group."

Interim athletic director Blake James informed the team of the decision Monday morning. University President Donna Shalala and the school's legal counsel were also involved in the decision.

"Considerable deliberation and discussion based on the status of the NCAA inquiry went into the decision-making process and, while acknowledging the impact that the decision will have on current student-athletes, coaches, alumni and fans, a determination was made that voluntarily withholding the football team from a second postseason was not only a prudent step for the University to take but will also allow for the football program and University to move forward in the most expedited manner possible," said the university's statement.

It continued, "The University and President Shalala have been clear from the start of the inquiry that Miami will cooperate fully and will seek the truth, no matter where the path might lead and that the institution will be stronger because of it. The University has already taken proactive measures to ensure more strict compliance with NCAA rules and continues to evaluate further steps."

James said the team was disappointed, as he would have expected.

"We feel it's a decision that's best for us moving forward," James said.

It's the first time since the 1981 and 1982 seasons that Miami will go consecutive years without a bowl trip. In 1983, the Hurricanes won the school's first of five national championships.

Schools that do not self-impose things like bowl bans when facing NCAA investigations often regret that decision. Most recently, Ohio State ? still unbeaten ? chose not to ban itself from a bowl last season, before the NCAA handed down punishments for the memorabilia-for-tattoos scandal. Instead of being in the mix for a BCS berth, and possibly a shot at the national title, the Buckeyes' season will end this weekend.

Miami's move, which was not unexpected, denies Miami the chance of playing in its first ACC title game ? the Hurricanes almost certainly would have gotten there if they beat Duke ? and also ends any chance that the team finishes its season playing what would amount to a home game at Sun Life Stadium, the site of the Orange Bowl.

The ACC champion goes to the Orange Bowl, and Miami's decision effectively ends the Coastal race. Georgia Tech will play Atlantic Division winner Florida State in Charlotte, N.C., on Dec. 1 for the conference title and automatic BCS spot.

Miami, however, still has a championship game of sorts waiting. If the Hurricanes beat Duke, they will finish tied for first in the Coastal. And for a program that's has been starting over in many respects, that alone would provide a boost heading into 2013.

"We're here as a family," quarterback Stephen Morris said. "We've faced a lot of adversity here at this university. Something that was done a couple years ago affects us right now, but that's what men have got to do. We've got to step up and stay focused on the task at hand and stay together."

The rogue booster who sparked the investigation, convicted and jailed Ponzi scheme architect Nevin Shapiro, pleaded guilty to charges that he orchestrated a $930 million scam in September 2010 ? three months before Golden arrived in Coral Gables.

Still, Golden reaffirmed his commitment to Miami on Monday, saying he's "not in the business of searching for another job right now."

"I can see the end. I can see what we're going to become," Golden said.

Miami's decision will add to the ACC's bowl dilemma this season.

The ACC has affiliations with eight bowl games, but this year, it will be unable to fill those spots. North Carolina is ineligible because of NCAA sanctions, Miami is choosing to be ineligible, and Maryland, Boston College and Virginia have already lost too many games to be bowl-qualified ? so at most, seven teams will be going to the postseason. Wake Forest (5-6) and Virginia Tech (5-6) could merit bowl invitations if they win this coming weekend.

The ACC pools its bowl revenue and shares it among all 12 of its member schools, but it's unclear how that process will be affected ? if at all ? since the league will not receive payouts from the usual number of postseason matchups. James said he believes Miami will remain part of the bowl-distribution process.

Golden said his message to the team was simple: Stay the course.

"I'm here to lead them," Golden said.

Time asymmetry confirmed: Time's quantum arrow has a preferred direction

ScienceDaily (Nov. 19, 2012) ? Time marches relentlessly forward for you and me; watch a movie in reverse, and you'll quickly see something is amiss. But from the point of view of a single, isolated particle, the passage of time looks the same in either direction. For instance, a movie of two particles scattering off of each other would look just as sensible in reverse -- a concept known as time reversal symmetry.

Now the BaBar experiment at the Department of Energy's (DOE) SLAC National Accelerator Laboratory has made the first direct observation of a long-theorized exception to this rule.

Digging through nearly 10 years of data from billions of particle collisions, researchers found that certain particle types change into one another much more often in one way than they do in the other, a violation of time reversal symmetry and confirmation that some subatomic processes have a preferred direction of time.

Reported this week in the journal Physical Review Letters, the results are impressively robust, with a 1 in 10 tredecillion (1043) or 14-sigma level of certainty -- far more than needed to declare a discovery.

"It was exciting to design an experimental analysis that enabled us to observe, directly and unambiguously, the asymmetrical nature of time," said BaBar collaborator Fernando Mart?nez-Vidal, associate professor at the University of Valencia and member of the Instituto de Fisica Corpuscular (IFIC), who led the investigation. "This is a sophisticated analysis, the kind of experimental work that can only be done when an experiment is mature."

BaBar, which collected data at SLAC from 1999 to 2008, was designed to tease out subtle differences in the behavior of matter and antimatter that might help account for the preponderance of matter in the universe. It produced almost 500 million pairs of particles called B mesons and their antimatter counterparts B-bar mesons for study. BaBar scientists found that B mesons and B-bar mesons do, indeed, behave differently in ways that violate so-called CP symmetry, which incorporates the symmetries of charge (positive versus negative) and parity (which can be thought of as left-handedness versus right-handedness). This discovery of CP violation contributed to the 2008 Nobel Prize in Physics.

CP symmetry is linked with time reversal symmetry through the CPT (charge-parity-time) Theorem, which states that the three symmetries must remain in balance for any given particle system. If one of the symmetries is out of whack, at least one of the others must be, too.

So the BaBar data, with its evidence of CP symmetry violation already in hand, was a good place to look for violation of time reversal symmetry that would serve to balance CPT as a whole.

BaBar's new time violation analysis was based on a concept proposed in 1999. Researchers examined a chain of particle transformations in which B mesons flipped between two different states called B-zero and B-even. Taking advantage of the quantum entanglement of the B mesons, which enables information about the first decaying particle to be used to determine the state of its partner at the time of the decay, they were able to find that these transformations happened six times more often in one direction than the other.

"This is a fresh way to understand data we had already used to measure CP violation," said BaBar physics coordinator Abner Soffer, associate professor at Tel Aviv University. "By looking at it slightly differently we were able to undeniably see time violation as well. What's nice is that the effect was there the whole time, but nobody had thought about it the right way before."

Time violation had previously been seen in particles called neutral kaons by the CPLEAR experiment at CERN, but that measurement was not direct because of the inability to distinguish T violation from CP violation, and the interpretation of those results drew some criticism. It's hard to set up laboratory conditions that can see time reversal violation, Mart?nez-Vidal explained. But BaBar provided just the right conditions for a clear, direct measurement.

"In the past, a true test of time reversal symmetry with unstable particles was considered to be impossible," said BaBar associate Jos? Bernab?u, a professor at the University of Valencia and IFIC, and one of the originators of the analysis concept. "It's spectacular that the solution came from the same entanglement phenomenon used for quantum communication and computing."

Michael Roney, BaBar spokesperson and professor at the University of Victoria in Canada, said "BaBar's data has been extremely fruitful and continues to produce important results, such as this unique and unambiguous test of quantum field theory. As we continue to work on almost 100 measurements from BaBar that investigate the fundamental nature of time and matter, we're gratified to have further validated this underlying theory."

The Osgoode Society ? Thirty three years, eighty eight books, and ...

Four new titles were launched yesterday evening at the Osgoode Society's 33rd annual book launch and reception for authors and supporters. As usual, the event was presided over by Roy McMurtry, the progenitor and President of the Osgoode Society, and the genial host of most if not all of these occasions. He proudly noted that the Osgoode Society had now published 88 titles, over the thirty three years of its existence, and has established itself as one of the leading historical societies in the world.

The Osgoode Society is well known and respected for its approach to legal history. As is demonstrated by this years titles, it takes a diverse, inclusive and human approach to what constitutes history with topics ranging from the introduction of criminal law on the aboriginal plains, to the african ? canadian legal odyssey, from gun control to property law, all presented in a modest unassuming fashion. Definitely not the touting of dead British monarchs and the endless propaganda for the glory of the late and unlamented British Empire that passed for Canadian history when I was young.

This year Irwin Law joined the University of British Columbia Press and the University of Toronto Press in the mix of notable publishers that have collaborated with the Osgoode Society in publishing the legal history of Canada. Irwin Law is the stubbornly independent English language legal publisher that has done so much to enrich Canadian legal literature in recent years. The University of Toronto Press and the University of British Columbia Press are the leading academic presses in the country and to their credit have often supported the work of the Osgoode Society in the past. The partnering with the country's leading publishers has, I think, played a critical role in ensuring the success of the series.

ARMING AND DISARMING: A HISTORY OF GUN CONTROL IN CANADA
By R. Blake Brown

From the ?cole Polytechnique shootings of 1989 to the political controversy surrounding the elimination of the federal long-gun registry, the issue of gun control has been a subject of fierce debate in Canada. But in fact, firearm regulation has been a sharply contested issue in the country since Confederation. Arming and Disarming offers the first comprehensive history of gun control in Canada from the colonial period to the present.

In this sweeping, immersive book, R. Blake Brown outlines efforts to regulate the use of guns by young people, punish the misuse of arms, impose licensing regimes, and create firearm registries. Brown also challenges many popular assumptions about Canadian history, suggesting that gun ownership was far from universal during much of the colonial period, and that many nineteenth century lawyers ? including John A. Macdonald ? believed in a limited right to bear arms.

Arming and Disarming provides a careful exploration of how social, economic, cultural, legal, and constitutional concerns shaped gun legislation and its implementation, as well as how these factors defined Canada?s historical and contemporary ?gun culture". The University of Toronto Press Release

PROPERTY ON TRIAL: CANADIAN CASES IN CONTEXT
Edited by Eric Tucker, James Muir and Bruce Ziff

Property on Trial is a collection of studies of Canadian property law disputes ? some well-known, some more obscure ? that have helped to shape the contours of the principles and rules of property law over 150 years. These studies, written by some of Canada?s leading legal historians, range in time from a discussion of a nineteenth-century dispute over the ownership of seal pelts in Newfoundland to modern questions of what constitutes private property in a digital age. They investigate the relationship between private and public interests in property; the limits of private property owners? rights in relation to others, particularly neighbours and family; and the intersection of property law principles with other branches of the law, including criminal law, family law, and human rights.

The authors describe, in rich detail, the social, cultural, and political contexts in which the events unfolded, the backgrounds and personalities of the litigants, the skills of the lawyers, and the judicial attitudes of the day. On the one hand, Property on Trial is a collection of thoughtful and compelling stories about conflict in a wide variety of contexts, each with its own heroines and heroes, villains and ne?er-do-wells, winners and losers. On the other, it is an insightful look at the history of property law doctrine in Canada. Irwin Law Press Release

HUNGER, HORSES, AND GOVERNMENT MEN:
CRIMINAL LAW ON THE ABORIGINAL PLAINS, 1870-1905

By Shelley Gavigan

Scholars often accept without question that Canada's Indian Act(1876) criminalized First Nations. In this illuminating book, Shelley Gavigan argues that the notion of criminalization captures neither the complexities of Aboriginal participation in the courts nor the significance of the Indian Act as a form of law.

Gavigan uses records of ordinary cases from the lower courts and insights from critical criminology and traditional legal history to interrogate state formation and criminal law in the Saskatchewan region of the North-West Territories between 1870 and 1905. By focusing on Aboriginal people's participation in the courts rather than on narrow legal categories such as "the state" and "the accused," Gavigan allows Aboriginal defendants, witnesses, and informants to emerge in vivid detail and tell the story in their own terms. Their experiences ? captured in court files, police and penitentiary records, and newspaper accounts ? reveal that the criminal law and the Indian Act operated in complex and contradictory ways.

By showing that the criminal courts were as likely to include acts of mediation as coercion,Hunger, Horses, and Government Men takes the study of criminal law and criminalization in a new direction, one that challenges conventional wisdom and popular images of relations of power and discrimination in the courts. The holiday season of gift giving ? a reminder from Roy McMurtry

As usual, the event concluded with President McMurtry drawing attention to the holiday season of gift giving that will soon be upon us and to the benefit to the Osgoode Society and to the recipient of a gift of one of the many books now avialable from the Society, which he described as a "special club of people who support the history of their country and the administration of justice".

Marini: 10s wouldn't have helped me on 'DWTS'

Craig Sjodin / ABC

By Michael Maloney, TODAY contributor

It wasn?t shocking that Kirstie Alley was one of the two celebrities sent home in Tuesday night?s double elimination on "Dancing With the Stars: All-Stars." Despite her loyal fan base, the actress was trailing 20 points behind leader Melissa Rycroft.

Rather, it was Gilles Marini?s ouster that took everyone by surprise. Marini and his pro partner, Peta Murgatroyd, last season?s winner, were one of the highest scoring teams all season. But the duo told reporters after the show that they saw it coming,? especially after Emmitt Smith and his partner Cheryl Burke were called safe.

Marini suggested that the low score he and Murgatroyd received in the crucial swing marathon dance in week seven of the show ultimately cost them a spot in the semi-finals. The actor pointed out that he and Murgatroyd were one of the first couples eliminated in the dance, and it became an uphill battle to regain those lost points.

?Even if I had scored three 10s on Monday?s show I wouldn?t be (going to the semi-finals),? he suggested. ?The marathon just did me in.?

Marini said that he has no regrets about having participated in the all-stars season because he got to dance and strike up a friendship with Murgatroyd. An they plan on staying in touch.

?This is just the tip of the iceberg for us,? he said.

Alley was philosophical about her exit, which was announced earlier in the show.

?It was a great run,? she said. ?Maks (Chmerkovskiy) tried his hardest but come on! The bottom line is that there are extraordinary dancers here.?

Chmerkovskiy said it came down to the numbers. ?Mathematically, there was a 20-point difference between us and first place. The next couple ahead of us had 10 more points than we did.?

?Do we need to say this stuff?? Alley joked. ?It was so close!?

?Well, you are not the boss of me anymore,? Chmerkovskiy playfully shot back.

?It was so close,? Alley continued to insist. ?You have no idea. The difference between first place and us was, like, nothing!?

?She is insane,? Chmerkovskiy said with a smile.

Both ejected stars are returning to the television screen. Marini continues to film his role on the ABC Family series ?Switched At Birth? while Alley will film her sitcom, ?Giant Baby,? for TV Land on Dec. 10.

?I?m excited about that,? she said, confirming that Chmerkovskiy will appear on her new series at some point. ?But he is not playing a dancer.?

There?s one silver lining for the two ejected dance pros. Since Murgatroyd and Chmerkovskiy (who are reportedly dating) don?t have to report to the dance studio they can spend a little time together.

??We?ll probably get to sleep in tomorrow and (then) go out for breakfast,? Murgatroyd said. ??We have not done that for months. So, yeah, there?s a plus side -- even though we?re both sad to go.?

The Retirement Group / Benefits Blog / 800-900-5867: The Roth 401(k)

Some employers offer 401(k) plan participants the opportunity to make Roth 401(k) contributions. If you're lucky enough to work for an employer who offers this option, Roth contributions could play an important role in maximizing your retirement income. A Roth 401(k) is simply a traditional 401(k) plan that accepts Roth 401(k) contributions. Roth 401(k) contributions are made on an after-tax basis, just like Roth IRA contributions. This means there's no up-front tax benefit, but if certain conditions are met, your Roth 401(k) contributions and all accumulated investment earnings on those contributions are free from federal income tax when distributed from the plan. (403(b) and 457(b) plans can also allow Roth contributions.) Unlike Roth IRAs, where individuals who earn more than a certain dollar amount aren't allowed to contribute, you can make Roth contributions, regardless of your salary level, as soon as you're eligible to participate in the plan. And while a 401(k) plan can require employees to wait up to one year before they become eligible to contribute, many plans allow you to contribute beginning with your first paycheck. How much can I contribute? There's an overall cap on your combined pretax and Roth 401(k) contributions. You can contribute up to $17,000 of your pay ($22,500 if you're age 50 or older) to a 401(k) plan in 2012. You can split your contribution any way you wish. For example, you can make $10,000 of Roth contributions and $7,000 of pretax 401(k) contributions. It's up to you. But keep in mind that if you also contribute to another employer's 401(k), 403(b), SIMPLE, or SAR-SEP plan, your total contributions to all of these plans--both pretax and Roth--can't exceed $17,000 ($22,500 if you're age 50 or older). It's up to you to make sure you don't exceed these limits if you contribute to plans of more than one employer. Can I also contribute to a Roth IRA? Yes. Your participation in a Roth 401(k) plan has no impact on your ability to contribute to a Roth IRA. You can contribute to both if you wish (assuming you meet the Roth IRA income limits). You can contribute up to $5,000 to a Roth IRA in 2012, $6,000 if you're age 50 or older (or, if less, 100% of your taxable compensation). Should I make pretax or Roth 401(k) contributions? When you make pretax 401(k) contributions, you don't pay current income taxes on those dollars (which means more take-home pay). But your contributions and investment earnings are fully taxable when you receive a distribution from the plan. In contrast, Roth 401(k) contributions are subject to income taxes up front, but qualified distributions of your contributions and earnings are entirely free from federal income tax. Which is the better option depends upon your personal situation. If you think you'll be in a similar or higher tax bracket when you retire, Roth 401(k) contributions may be more appealing, since you'll effectively lock in today's lower tax rates. However, if you think you'll be in a lower tax bracket when you retire, pretax 401(k) contributions may be more appropriate. Your investment horizon and projected investment results are also important factors. A financial professional can help you determine which course is best for you. Are distributions really tax free? Because your Roth 401(k) contributions are made on an after-tax basis, they're always free from federal income tax when distributed from the plan. But the investment earnings on your Roth contributions are tax free only if you meet the requirements for a "qualified distribution." In general, a distribution is qualified only if it satisfies both of the following: ????????? It's made after the end of a five-year waiting period ????????? The payment is made after you turn 59?, become disabled, or die The five-year waiting period for qualified distributions starts with the year you make your first Roth contribution to your employer's 401(k) plan. For example, if you make your first Roth contribution to the plan in December 2012, then the first year of your five-year waiting period is 2012, and your waiting period ends on December 31, 2016. But if you change employers and roll over your Roth 401(k) account from your prior employer's plan to your new employer's plan (assuming the new plan accepts Roth rollovers), the five-year waiting period starts instead with the year you made your first contribution to the earlier plan. If your distribution isn't qualified (for example, if you receive a payout before the five-year waiting period has elapsed or because you terminate employment), the portion of your distribution that represents investment earnings on your Roth contributions will be taxable, and will be subject to a 10% early distribution penalty unless you are 59? or another exception applies. You can generally avoid taxation by rolling your distribution over into a Roth IRA or into another employer's Roth 401(k), 403(b), or 457(b) plan, if that plan accepts Roth rollovers. (State income tax treatment of Roth 401(k) contributions may differ from the federal rules.) What about employer contributions? While employers don't have to contribute to 401(k) plans, many will match all or part of your contributions. Your employer can match your Roth contributions, your pretax contributions, or both. But your employer contributions are always made on a pretax basis, even if they match your Roth contributions. That is, your employer's contributions, and investment earnings on those contributions, are not taxed until you receive a plan distribution. What else do I need to know? Like pretax 401(k) contributions, your Roth 401(k) contributions and investment earnings can be paid from the plan only after you terminate employment, incur a financial hardship, attain age 59?, become disabled, or die. Also, unlike Roth IRAs, you must begin taking distributions from a Roth 401(k) plan after you reach age 70? (or in some cases, after you retire). But this isn't as significant as it might seem, since you can generally roll over your Roth 401(k) dollars (other than RMDs themselves) into a Roth IRA if you don't need or want the lifetime distributions. Employers aren't required to make Roth contributions available in their 401(k) plans. So be sure to ask your employer if they are considering adding this exciting feature to your 401(k) plan.
