Hollywood studios win UK case to block pirate site (AP)

LONDON ? Hollywood film studios have won a court case in Britain blocking access to a website accused of flagrant infringement of copyright.

Justice Richard Arnold announced Thursday that he would issue an order which would compel BT PLC, the country's largest Internet service provider, to block access to the Newzbin2 website. The precise wording of the order will be subject to a further hearing in October.

The order was sought by six studios including Twentieth Century Fox, Paramount Pictures Corporation and Disney Enterprises. They were supported by recorded music, video gaming and publishing organizations.

Chris Marcich, European president of the Motion Picture Association, described Newzbin as a "a notorious pirate website which makes hundreds of thousands of copyrighted products available without permission and with no regard for the law."

The judge noted that the studios considered this to be a test case, and that if they won an order they would take similar action against other Internet service providers in the United Kingdom.

"Today's result is an important victory in the battle against a commercial pirate site which refused to operate within the law," said veteran film producer David Puttnam, who is president of the Film Distributors' Association.

BT described the judge's ruling as a "helpful" decision that provides clarity on the issues. "It clearly shows that rights holders need to prove their claims and convince a judge to make a court order," the company said.

The studios had won an injunction last year against Newzbin Ltd. to halt further infringement of copyrights.

Justice Arnold noted that the Newzbin1 site closed down, quickly succeeded by a new site at the same location.

"The operators of the Newzbin2 website are unknown, but the operation appears to have moved offshore. It is thus effectively beyond the reach of this court," the judge said.

People have noted the failure to demand higher yields for treasuries, and concluded that the debt markets don?t believe there?s any problem with August 2, or 10, or any other date we care to mention. ?In fact, this was largely out of disbelief that Washington could fail to act.

In fact, this week, the debt markets have begun to react. ?Banks are beginning to pull money out of treasury-heavy money market funds, which in turn are selling treasuries and putting their money in banks. ?This has the effect of reducing the financial flexibility of each. ?The repo market ? where financial institutions lend securities to one another, using treasuries as collateral ? is beginning to demand higher interest rates. ?Companies that don?t even like debt are issuing short-term commercial paper to make sure they have cash on hand. ?Let?s not turn this into panic ? it?s not. ?But the markets are beginning to take prudent and overdue steps to protect themselves against a loss of liquidity in treasuries, even if it doesn?t mean technical default.

In the meantime, it appears that Speaker Boehner has agreed to a stricter Balanced Budget Amendment requirement for the 2nd round of cuts & debt limit increases ? requiring passage rather than just a vote. ?I think this is a mistake.

There is every indication that Boehner Plan 2.0 was pretty close to the plan that he and Harry Reid presented to the President on Sunday, and which he indicated he would veto. ?But a close reading of the tea leaves also indicates that he was hoping that a strong enough statement against it would prevent him from actually having to make that decision. ?If he had signed it, it would have strengthened the conservative case for governance immensely.

Now, the House has probably made it more likely that they will end up voting on ? and probably passing ? some compromise between McConnell and Reid. ?That deal would, in fact, work towards marginalizing the Tea Party groups who have done so much to get us to this point.

I hope I?m wrong, and that the wording of the BBA is something that can get passed ? it requires no presidential signature ? and that the extra time we?re buying is put to good use making the case for it. ?Certainly Obama & the Democrats? desire to run the federal budget on auto-pilot helps in that regard.

But if not, and if the 30 or so Republicans end up setting the stage for an exact repeat of this in 6 months, with no BBA in hand, they may well end up moving the debate to the left, rather than to the right.

One other point ? I do think reasoned analyses such as McArdle?s, which show what will likely happen if we don?t raise the ceiling, without the histrionics, actually help our case down the road. ?If the markets do shudder a little bit, it should server as a spectre of what will actually happen, for real, when the debt markets finally decide to take that decision out of Washington?s hands altogether.

MILAN (AFP) ? The Italian treasury was forced to pay increased rates for a nine-billion-euro ($13 billion) bond issue on Tuesday, as Italy's economy continues to feel the pressure on financial markets.

The treasury issued 7.5 billion euros in six-month bonds at a fixed yield or rate of 2.269 percent compared to 1.988 percent for the last similar operation.

The treasury also raised 1.5 billion euros in two-year bonds at 4.038 percent compared to 3.219 percent previously, indicating investor concerns.

As she approached the glass doors to the Kendall's household, Zoe stopped and peeked into the door. She bit her lip. She couldn't see a thing. Zoe looked at her watch. It read 1:59 a.m. Connor should be there to let her in any minute now. She just hoped he hadn't forgotten.

Watching the debate, US markets show no panic yet (AFP)

NEW YORK (AFP) ? Market experts are closely following the US debt ceiling talks, but they appear more worried about the economic impact of failure to reach an accord rather than a dramatic slide in the stock market.

Still, it is the fear of a dramatically lower stock market opening Monday that has helped propel congressional leaders and the White House to try to finish hammering out a long-term deficit reduction plan this weekend.

Market analysts told AFP that while the markets might be nervous, they are hardly on the verge of panic, just 10 days before an August 2 deadline for the United States to default on its debt.

Certainly the markets "would have sold off" Friday if talks had collapsed between the White House and Republicans during trade, said David Kotok, the president of Cumberland Advisors.

Instead, Republican House Speaker John Boehner made a shock late evening announcement that he was quitting negotiations with the president in favor of talks only with Senate leaders.

By now, Kotok said, the markets have had time to "digest" the news.

While still skittish, "the minute there is a glimmer of resolution," they will become very robust, he added.

And Boehner has since told fellow Republicans he hoped for a deal with Democrats by Sunday evening.

Such a breakthrough aimed to reassure jittery world markets that the world's richest country would pay its bills after August 2, with Asian investors first to render their judgment on the stalemate in a matter of hours.

At Natixis bank, economist Evariste Lefeuvre said the "11th hour" mentality will "hurt the dollar in the days ahead."

Still, Lefeuvre asked, even if the United States briefly defaults, or the rating agencies downgrade US debt, where else will people turn?

"Investors who hold US debt, are they going to sell it... and buy German, French or Dutch debt?" he asked.

The challenge is the lack of secure debt alternatives in sufficient quantities with the safety of US Treasury notes.

"There is no safe alternative to $8 trillion dollars in American debt," said Lefeuvre. A sudden collapse in the US markets, therefore, is not on the horizon, he believes.

"The real risk is an aversion to risk in general," he said, adding that rising interest rates could undermine an already fragile recovery.

Lefeuvre said it's not certain that US stocks will tumble if the debt ceiling is not resolved, since the US economy still remains one of the strongest in the world.

On the other hand, the absence of a debt deal could have a "dramatic" impact, he noted, especially if the Obama administration decides to pay back its creditors before distributing retirement and health coverage payments.

"It might not be in default on its debt, but that would come at the price of an immediate and very violent contraction in public expenditures," with a sharp reduction in disposable household income to follow, said Lefeuvre.

The problem, said Kotok, is that the "economic impact is already showing, in the employment statistics, and in shrinking local governments... it already is drastic."

Kotok said that if a deficit reduction plan is reached, the markets will move higher in August.

For commodity analyst Matt Smith of Summit Energy, an agreement still appears inevitable.

"If there isn't a solution, there will be an immediate reaction," he said. "But right now, it seems such an outlier that not many people are taking it into account... there's a certain amount of complacency, everyone still believes there will be a resolution."

Free Money Finance: Your Insurance May Cover More than You Think ...

Remember the story of my friend who put gasoline into his diesel engine? Since then, the story got worse for him. The gas had penetrated most of his fuel system to the point where he needed an additional $4,000 in repairs. Ugh. That's a HUGE amount. But the car was only a couple years old, so he had to go ahead with it.

On a whim, he called his insurance company to see if they would offer any help. They said they would cover the whole thing, less his deductible. Pretty cool for him, huh?

I asked him why this was when the problem was something he caused. He said he asked them and they said:

• They cover many situations when you do something that harms your car and is completely your fault (for lack of paying attention or whatever.) For example, if you back your car into a pole, they'll cover the repair. Same goes for the situation where you put gasoline into a diesel engine.


• They cover lots of things that most people assume they don't. People simply fail to ask if they do and thus miss many of the benefits of their insurance.

A few thoughts on this from me:

• I would never in a million years think that they would cover something as blatant as putting gas into a diesel engine. Shows what I know.


• Like mom used to say, "it never hurts to ask."


• In many (most?) cases, it's not worth making a claim. If you do something that costs $200 to repair, it's probably better IMO to simply pay for it. The hit to your premiums will likely be more than the benefit you gain.


• That said, if the cost is very high, go ahead and claim it. Sure, my friend's premiums will likely go up, but they can afford to go up a ton since he's getting way over $4,000 (the new cost PLUS the cost of work he had done previously). It will take a long time for premium increases to cover that amount.

Anyone out there ever had a problem they thought would never be covered by insurance but it turned out to be covered?

More papers dragged into hacking row (AFP)

LONDON (AFP) ? Phone-hacking allegations spread beyond the felled News of the World to other British tabloids on Saturday, though the claims were strongly denounced by their proprietors.

Former journalists at the Daily Mirror and Sunday Mirror -- the main tabloid competitors to Rupert Murdoch's British stable -- reportedly said the illegal hacking of voicemails was widespread at their papers too.

The scandal has also rocked the British police and even given Prime Minister David Cameron a rough ride, but has so far largely been limited to the News of the World, which Murdoch shut on July 7 amid public outrage.

James Hipwell, a former Daily Mirror financial journalist jailed in 2005 for buying shares before tipping them in the paper, said he was aware of hacking because he worked next to the showbusiness desk where it was rife.

"You know what people around you are doing," the 45-year-old told The Independent newspaper.

"They would call a celebrity with one phone and when it was answered they would then hang up. By that stage the other phone would be into their (the celebrity's) voicemail and they would key in the code."

"There was a great hilarity about it."

Hipwell worked at the Mirror for two years until 2000 when it was under the editorship of Piers Morgan, himself a former News of the World editor. Hipwell was sacked by the Mirror over the so-called "City Slickers" scandal.

Morgan, who is now a presenter for US television news network CNN, has denied having any knowledge that phone hacking went on under his editorship and came out fighting on Saturday.

He made a fresh demand for an apology from Louise Mensch, a British lawmaker on a parliamentary committee which quizzed Rupert and James Murdoch on Tuesday, who claimed during the hearing that Morgan had admitted to phone hacking.

"Now then Louise Mensch -- will you be making (a) public apology for your lies in parliament about me, or do I have to write to (committee chairman) John Whittingdale?" Morgan said on Twitter.

"You could just have the guts to accuse me of phone hacking outside of parliamentary privilege, and see how you get on."

Separately the BBC quoted an unidentified former Sunday Mirror journalist who worked on the paper in the past decade and claimed to have witnessed routine phone hacking in the newsroom.

Trinity Mirror, the group which publishes both papers, said its journalists work within the law and the code of conduct of Britain's self-regulatory Press Complaints Commission.

It said Hipwell's allegations were "totally unsubstantiated".

On Thursday it emerged that police had requested files from a British data protection regulator which published a report showing the non-Murdoch Daily Mail, the Mirror and the Trinity Mirror-published The People were the biggest users of private investigators to seek confidential information.

Meanwhile police are to investigate claims of phone hacking in Scotland, which has its own legal system, and whether witnesses lied during a perjury trial last year.

Former News of the World editor Andy Coulson -- who went on to become Cameron's media chief before resigning and being arrested this year -- was among those who gave evidence.

Also the Daily Telegraph newspaper said Saturday that British finance minister George Osborne dined with Rupert Murdoch in New York in December, two weeks before Britain's media regulator was originally due to decide on whether to approve Murdoch's bid for full control of pay-TV giant BSkyB.

Murdoch's US-based News Corp. was forced to abandon a bid for full control of the lucrative pay-TV satellite broadcaster earlier this month because of the scandal.

The Treasury refused to discuss who attended, but insisted that BSkyB was not discussed.

The Daily Telegraph also said that Lord Brian Leveson, the judge in charge of the phone-hacking inquiry, went to two parties in the last year at the home of Matthew Freud, a public relations executive married to Murdoch's daughter Elisabeth.

The BBC reported that Leveson had told Cameron of his Murdoch connections before he was appointed last week.

Cameron's Downing Street office said he attended the events in his capacity as sentencing council chair, and "nothing more".

Dow Jones editor-in-chief Robert Thomson, the American flagship of Murdoch's media empire, meanwhile reminded journalists that they must follow a code of ethics in a memo to all staff.

In the wake of the phone-hacking scandal, Thomson said Dow Jones reporters needed to be alert "and hold ourselves to higher standards of probity than other news organizations".

"It is clear to every one of you how much emphasis that we collectively place on ethics at Dow Jones, but, in light of recent events in London, it is worth re-emphasizing those principles," he wrote.

Thomson, former editor-in-chief of the Times of London another paper owned by Murdoch's News Corp., took up his post at Dow Jones in 2007.

Dow Jones also belongs to News Corp. and is part of its Consumer Media Group, which also publishes The Wall Street Journal. It employs about 2,000 journalists around the world.

William Randolf HearstIt was 1 a.m. on a hot July night when detectives marched into the offices of the New York World. "Where's the head?" they demanded.

In the summer of 1897, that question meant just one thing in Manhattan newsrooms, and it wasn't a request to meet the managing editor. The head everyone sought was of William Guldensuppe, a masseur who had disappeared in late June from his Hell's Kitchen apartment. He'd reappeared scattered in pieces along the Lower East Side, the Bronx, and Brooklyn. What was still missing, though, was his head?which, rumor had it, a jealous lover had hidden inside a block of plaster.

From the Nov. 28, 1897, edition of the New York Herald To William Randolph Hearst, the crime was perfect opportunity to trumpet his newly launched New York Evening Journal. Hearst offered a whopping $1,000 reward to solve the crime, and even formed a "Murder Squad" of reporters who were ready to resort to flashing badges and pistols to make citizen's arrests. Yet his stunts were merely improvements on the carnivalesque populism of rival publisher Joseph Pulitzer. Featuring celebrity news and scandal, Pulitzer's New York World had also created the world's first color comic section, and the popularity of strips like "The Yellow Kid" inspired competitors to scoff that the World and Journal were selling comic-strip journalism?"Yellow Journalism," they called it.

Not to be upstaged by Hearst's Journal, the World stole evidence from the Guldensuppe murder scene by shaving off a piece of a floorboard, testing it, and proclaiming BLOOD IN THE HOUSE OF MYSTERY. They also hired divers to search the East River for Guldensuppe's head. But after a World diving crew was spotted surreptitiously drawing a slimy white mass out of the river, the delicate matter of legality arose. The New York Herald believed the World had the scoop of the day?literally scooping William Guldensuppe's head off the bottom of the East River?and that Pulitzer's henchmen were now concealing the ghastly thing in their editorial offices. In a burst of righteous indignation, the Herald called in the police.

It wasn't the first such call the police had received. Children proved especially fond of claiming severed-head sightings, as when a boy found a plaster-caked head in Branchport, N.J., panicked, and threw it into a local stream. Despite a welter of yellow-press stories about "little Tommy Cooper" and his ghastly find, the police couldn't turn it up again. It took a more sober-minded Herald reporter to discover why. "The main fault with the Branchport discovery," he ventured, "is that there is no such person as Tommy Cooper."

Though such corrections were often necessary, the yellow papers were punishing their competitors so badly that for one precarious night, until it got its finances in order, the Evening Telegram ceased publication altogether. The New York Times, barely recovered from near-bankruptcy itself, tried beating back at the tide of Yellow Journalism by running a pointed new motto on its front page: "All The News That's Fit To Print." But other papers inexorably drifted with Hearst's powerful current. On the same day that the Evening Journal boasted such edifying stories as "Cocaine Phantoms Haunt Him" and "Hypnotism Nearly Kills," one could also find all these headlines on a single page of the more respectable New York Herald:

New York papers now ran far more column inches on crime and accidents than other cities, and the Journal ran so much crime copy in combination with sports and comics that the traditional staples of business, labor, and religion stories were nearly crowded out altogether. But Hearst knew his readers, and he knew what they liked." The public," he reminded his staff, "likes entertainment better than it likes information."

And so Guldensuppe's head would reappear whenever the news got slow. Three more boys spotted a head floating by the 117th Street Boathouse, but to no avail. Yet another "decomposed mass" frightened passing ferry passengers and was indeed found to be a head?but of "a large fish." But when a 7-year-old girl from Queens found an actual chunk of plaster with hair still stuck to it from a local ditch, matters began to look more promising. Closer examination revealed it might have contained a head?of cabbage.
